If there's any logic to taxation, it's that "sin taxes" are easier to pass - so anything that puts an extra monetary burden on gamblers, users of tobacco and/or alcohol, etc., is an easy target for tax laws and regs. Rule #2 is tax those who exist in small numbers, have little political clout, and on whom the tax can be very productive.
The laws governing taxation are NOT passed by the IRS, although they can promulgate a lot of regs at the direction of the legislature, and these have the force of law. I have no idea if the rules being discussed are from statute or regulation, and in the end it doesn't matter, except it's sometimes nice to know whether to yell at your congressman (remote chance that it will have some impact) or the IRS (don't waste your breath, they answer to no constituency)
