If Bellagio has recently been charging the tax to its comped players, it didn't in the past so there had to have been a bit of confusion within the industry prior to this agreement/settlement.

For as long as I can remember, my experience has been that some restaurants did and some restaurants didn't charge sales tax on a comped meal. Eventually I came to the (possibly erroneous) conclusion that the restaurants that did not charge sales tax were the restaurants that the casino owned. The restaurants that did charge sales tax were the ones that were owned by other people/companies. It was a rule of thumb that seemed to hold true; though, there might have been exceptions that I don't remember.
