I believe, if 'indeed' this is Not a Private Property, then the ACLU has won the case already. If that is all the case hinges on, it shouldn't even be brought to trial.
Not that I like these kinds of situations either. The laws should be that within City Limits, there is no Pan-Handling, Porn shoved in your Face or making $ arbitrarily, wherever you please without a designated area & without a license.

It's about a lawsuit filed by a patron at the Hard Rcok. Security guards entered his room at 4am over an alleged domestic disturbance. They had the wrong room according to the defendant as he was alone. He was arrested for tresspassing by Metro and evicted from the room.
The second part of the article was more interesting. If you have been on the Strip lately you have seen people dressed as Superman, Transformers and other characters asking for donations to be photographed with them or just taking a picture. To my understanding that is not allowed. Most casinos don't do anything about them as they have same rights as porn slappers. The Venetian tries to claim that the sidewalk in fron to their casino is private property. A friend of mine who knows an ACLU lawyer says on the contrary their sidewalk is not private property. The Venetian unlike any other casino in town has been able to keep porn slappers and anybody else trying to do business off their sidewalk.
Two brothers dressed as Zorro and Darth Vader tried to challenge this premise. The Venetian security guards backroomed both of them for over 1 hour before throwing them off the property. The Venetian also called Metro to have them searched.
I am interested to see the outcome of this case. If the Venetian loses they have will same annoying porn slappers, street performers and hustlers working their sidewalk just like the rest of the Strip. I'm rooting for the Venetian. It's the only place you can walk on Las Vegas Boulevard and not be bothered. The ACLU rarely loses and this a federal lawsuit.
