Many video slots work that way. Similar to the "Stations" progressive bonus system.
Since a randomly preselected "coin in" point triggers these, the more you bet, the more likely you will trigger it.
EV for these type of machines does not usually change based on bet level.
This group has discussed this situation a few months ago as it applies to the Aristocrat slots "major" and "minor" jackpots to determine when you should attack these. 
Without going into the math, at one of the casinos I monitor for Vpfree, the "major" contributes 0.375% EV and "minor" 0.75% EV no matter what your bet level. (Very low compared to LV versions.)
Since I estimate that the base game is only 86% EV, the casino has certainly not made an error by having these.

Machines that allow you to hit a progressive or banked bonus on min bet? They can be found on practically any casino floor. Many of the new slots work this way. Probably design oversights, the machines may not get tested at min bet and casinos may assume that min-bettors can't beat them.
