One of the problems is that the general public doesn't understand the difference, and most of them just don't care. Why do you think people will play an 8/5 JOB game when a 9/6 game sits empty right next to them? Besides just being plain unobservant, there are a LOT of people who think the pay table doesn't really make a difference, or even worse - think the 9/6 machine must be set "tighter" somehow. And to make matters more confusing, there are some gaming jurisdictions where these people are right!
If everyone understood and demanded real, random video poker, (and stopped playing the "fake" games) the casinos that operate in these VLT type jurisdictions might put pressure on the regulators to change the rules, but that's not going to happen. If you try to explain the concepts of random card selection, calculated return based on the pay table, etc., most people will look at you like you just turned into a two headed alien.
